1. Agreement to Terms

By accessing or using Instarate ("Platform", "Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Platform.

2. Description of Service

Instarate is a platform that connects users with artisans who offer various services. Our Platform provides:

  • Artisan profiles grouped by location and service category
  • AI-generated summaries of artisan feedback
  • User reviews and ratings
  • Service previews with prices and durations
  • Reservation booking system

Important: Instarate is a platform only. We do not provide the artisan services ourselves, nor do we employ or control the artisans.

3. User Accounts

Registration:

  • You must provide accurate information (email address, Instagram username)
  • You are responsible for maintaining the security of your account
  • You must be at least 16 years old to use this Platform

Account Termination:

We reserve the right to suspend or terminate your account if you:

  • Post abusive, fake, or misleading reviews
  • Fail to honor reservations without cancellation
  • Violate these Terms of Service
  • Engage in fraudulent or illegal activity

4. User Reviews and Feedback

Posting Reviews:

  • You may post reviews for artisans you have used
  • Reviews must be honest, accurate, and based on your actual experience
  • Reviews must not contain abusive, defamatory, or offensive content
  • Reviews must not contain spam or promotional content

Content Ownership:

By posting a review on Instarate, you grant us full ownership of the content. We may:

  • Display your review on artisan profiles
  • Use reviews to generate AI summaries
  • Use reviews for marketing and promotional purposes
  • Keep reviews on the Platform even if you delete your account

Review Moderation:

  • We reserve the right to remove reviews that violate our guidelines
  • We may remove fake, abusive, or fraudulent reviews
  • Artisans may dispute reviews they believe are false or unfair
  • We will investigate disputed reviews and make a final decision

Username Display:

Your Instagram username may be displayed publicly with your reviews.

5. Artisan Services

Artisan Profiles:

  • Artisans manage their own service information (prices, schedules, descriptions)
  • Artisans are independent businesses, not employees of Instarate
  • We do not verify artisan qualifications, licenses, or business registration

Disclaimer:

Instarate is not responsible for:

  • The quality, safety, or legality of artisan services
  • The accuracy of artisan-provided information
  • Disputes between users and artisans
  • Injuries, damages, or losses resulting from artisan services
  • Artisan availability or service delivery

You use artisan services at your own risk.

6. Reservations

Booking Process:

  • Reservations are made through our Platform
  • You communicate directly with artisans regarding your booking
  • Payments are made directly to artisans, not through Instarate

Cancellation Policy:

  • Users may cancel reservations up to 24 hours before the scheduled appointment
  • Cancellations made less than 24 hours before may result in penalties (determined by the artisan)
  • Repeated failures to honor reservations may result in account suspension

No-Shows:

Failure to appear for a reservation without proper cancellation may result in:

  • Account warnings
  • Account suspension or termination
  • Being blocked from future reservations

7. Payments and Refunds

Payment:

  • All payments are made directly to the artisan
  • Instarate does not process, hold, or receive any payments
  • We do not charge commission or booking fees (at this time)

Refunds:

  • Refund policies are determined by individual artisans
  • Disputes about refunds must be resolved directly with the artisan
  • Instarate is not responsible for processing or guaranteeing refunds

8. Intellectual Property

Platform Content:

  • The Instarate website, design, and functionality are owned by Instarate
  • You may not copy, reproduce, or distribute our Platform content without permission

User Content:

  • User reviews become the property of Instarate upon posting
  • Artisans retain ownership of their service descriptions and images

9. Prohibited Activities

You may not:

  • Post false, misleading, or fraudulent reviews
  • Harass, threaten, or abuse other users or artisans
  • Use the Platform for illegal purposes
  • Attempt to hack, damage, or disrupt the Platform
  • Create multiple accounts to manipulate reviews
  • Scrape or collect data from the Platform without permission
  • Impersonate another person or business

10. AI-Generated Content

We use artificial intelligence to:

  • Summarize user feedback for artisan profiles
  • Analyze trends and patterns in reviews

AI summaries are generated automatically and may not be 100% accurate. They are provided for informational purposes only.

11. Third-Party Services

Our Platform integrates with:

  • Instagram: For displaying artisan profiles
  • Google Analytics: For website analytics

We are not responsible for the practices or policies of these third-party services.

12. Disclaimers and Limitations of Liability

"AS IS" Service:

Instarate is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy of artisan information
  • Quality or safety of artisan services

Limitation of Liability:

To the maximum extent permitted by law:

  • Instarate is not liable for any damages arising from your use of the Platform
  • We are not liable for disputes between users and artisans
  • Our total liability shall not exceed the amount you paid to us (currently zero)

13. Indemnification

You agree to indemnify and hold Instarate harmless from any claims, damages, or expenses arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your reviews or content
  • Your interactions with artisans

14. Governing Law

These Terms are governed by the laws of Poland. Any disputes shall be resolved in Polish courts.

15. Changes to Terms

We may update these Terms of Service at any time. We will notify you of significant changes by:

  • Email notification
  • Notice on the Platform

Continued use of the Platform after changes constitutes acceptance of the new Terms.

16. Dispute Resolution

Between Users and Artisans:

Disputes about services, payments, or refunds must be resolved directly between you and the artisan.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in effect.
